Terms of Service — Pulse Recovery

1. Overview

This website is operated by Pulse Recovery, an online retail business based in South Africa.

Throughout these Terms of Service, “Pulse Recovery”, “we”, “us” and “our” refer to the operator of this store. “You” and “your” refer to customers and other users of the website.

These Terms govern your access to our website, use of our services and purchases made through the store.

By accessing the website or placing an order, you agree to these Terms and our:

  • Privacy Policy;

  • Shipping Policy;

  • Return and Refund Policy; and

  • Legal Notice.

If you do not agree to these Terms, you should not use the website or place an order.

Nothing in these Terms excludes or limits a consumer right that cannot lawfully be excluded.

2. About Pulse Recovery

Pulse Recovery operates an online retail store offering products that may include:

  • Clothing and activewear;

  • Fitness, stretching and recovery equipment;

  • Health, beauty and skincare products;

  • Personal-care products; and

  • Consumer technology and electronic accessories.

Some products are sourced, stored or fulfilled by independent suppliers through dropshipping and other fulfilment arrangements. Items in the same order may be dispatched separately or from different locations.

3. Eligibility and Customer Accounts

You must have the legal capacity to enter into a binding agreement.

If you are under the age of majority in your jurisdiction, you may use the store or make purchases only with the involvement and consent of a parent or legal guardian.

You must provide accurate, current and complete information when creating an account, placing an order or communicating with us.

You are responsible for protecting your account credentials and for activity conducted through your account. Contact us immediately if you believe your account has been accessed without authorization.

4. Product Information

We take reasonable steps to provide accurate product descriptions, photographs, dimensions, sizing information, specifications, ingredients and compatibility information.

However:

  • Colours may vary because of screen settings;

  • Packaging may change without materially changing the product;

  • Minor manufacturing differences may occur; and

  • Supplier information and product availability may change.

You are responsible for reviewing the product information, measurements, sizing, ingredients, compatibility and warnings before purchasing.

If a product is materially different from its description, your rights under our Return and Refund Policy and applicable consumer law remain available.

5. Health and Safety Information

Information on this website is provided for general informational and commercial purposes. It is not medical advice or a substitute for professional diagnosis or treatment.

Unless expressly and lawfully stated, our products are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Consult an appropriate healthcare professional before using a recovery, massage, stretching, fitness, skincare, beauty or personal-care product if you:

  • Have an injury or medical condition;

  • Are pregnant or breastfeeding;

  • Have sensitive skin or allergies;

  • Take medication that may affect product use;

  • Recently underwent surgery; or

  • Are uncertain whether a product is suitable for you.

Always follow the instructions and safety warnings supplied with the product. Stop using a product and seek appropriate advice if you experience pain, irritation, an allergic reaction or another adverse effect.

6. Prices and Taxes

Unless another currency is displayed at checkout, prices are shown in South African Rand (ZAR).

Shipping charges, customs duties, import taxes and other applicable charges may be added or payable separately as explained at checkout and in our Shipping Policy.

Taxes will be collected only where Pulse Recovery is legally required and properly configured to collect them. Nothing on the website should be interpreted as confirmation that Pulse Recovery is VAT registered unless a valid VAT registration number is expressly displayed.

We may change prices and promotions before an order is placed. Price changes will not affect an order we have already accepted.

If a material pricing or listing error occurs, we may:

  • Contact you for instructions;

  • Correct the error before accepting the order; or

  • Cancel the affected order and refund any amount already paid.

7. Orders

Submitting an order constitutes an offer to purchase.

An automated order acknowledgement does not necessarily mean that we have accepted your order. Acceptance occurs when we confirm fulfilment or dispatch, subject to applicable law.

We may refuse or cancel an order for legitimate reasons, including:

  • Suspected fraud or unauthorized payment;

  • Product unavailability;

  • Delivery restrictions;

  • An obvious pricing or listing error;

  • Incomplete customer information; or

  • An inability to fulfil the order.

If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.

Please review your order carefully before submitting it. Contact us immediately if you need to correct or cancel an order. Changes cannot be guaranteed after processing or dispatch has begun.

8. Payments

Available payment methods are displayed at checkout and may include PayPal and other payment providers.

Payments are processed by independent payment providers according to their own terms, security procedures and privacy notices.

By submitting payment information, you confirm that:

  • The information is accurate and complete;

  • You are authorized to use the payment method; and

  • You authorize the applicable charges for your order.

Pulse Recovery does not generally receive or store complete payment-card details.

9. Shipping and Delivery

Shipping destinations, processing times, delivery estimates, charges, tracking and customs information are explained in our Shipping Policy.

Current standard shipping charges are:

  • South Africa: R50

  • Eligible international destinations: R100

Current estimated delivery periods are:

  • South Africa: 7–15 business days from order confirmation;

  • Eligible international destinations: 10–25 business days from order confirmation.

These timeframes are estimates and not guarantees. Deliveries may be affected by suppliers, couriers, customs processing, public holidays, severe weather, incorrect customer information or other circumstances outside our reasonable control.

Risk of loss or damage passes to you when the goods are delivered to you or a person you nominate, except where applicable law provides otherwise.

10. International Orders

International shipping is available only to destinations enabled at checkout.

International customers may be responsible for customs duties, import taxes, handling charges or other fees imposed by the destination country. Unless expressly collected at checkout, these charges are not included in the product or shipping price.

Customers are responsible for ensuring that products can lawfully be imported into and used in their destination country.

Mandatory consumer rights applicable in a customer’s country are not excluded by these Terms.

11. Returns, Faults and Refunds

Returns, exchanges, damaged products and refunds are governed by our Return and Refund Policy and applicable consumer law.

Eligible change-of-mind returns may be requested within 30 calendar days after delivery, subject to the conditions and exclusions in that policy.

Different rules may apply to:

  • Opened cosmetics and skincare products;

  • Personal-care and hygiene-sensitive products;

  • Worn or washed clothing;

  • Used recovery equipment;

  • Personalized products;

  • Gift cards; and

  • Products marked final sale, where permitted by law.

These restrictions do not remove your rights concerning defective, damaged, unsafe or incorrectly supplied goods.

South African customers retain applicable rights under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

Customers in the European Union or another jurisdiction with mandatory withdrawal rights retain those rights where applicable.

12. Damaged, Defective or Incorrect Products

Inspect your order as soon as reasonably possible after delivery.

If an item is damaged, defective, unsafe or different from what you ordered, contact us at recoverypulse7@gmail.com and provide:

  • Your order number;

  • A description of the problem; and

  • Clear photographs or video where reasonably possible.

Where a claim is valid, we will provide an appropriate remedy in accordance with applicable law. This may include a repair, replacement, full or partial refund, or another agreed remedy.

Nothing in these Terms limits the statutory warranty or other protections applicable to defective goods.

13. Intellectual Property

The Pulse Recovery name, original website copy, layout, graphics and other content created specifically for Pulse Recovery are owned by or licensed to Pulse Recovery.

Product photographs, manufacturer names, trademarks, logos and supplier-provided material may remain the property of their respective owners.

You may use the website only for lawful, personal and non-commercial purposes.

You may not reproduce, modify, distribute, republish, scrape or commercially exploit protected website content without authorization from the relevant rights holder, except where permitted by law.

14. Reviews and Customer Content

If you submit a review, photograph, comment or other content, you confirm that:

  • You have the necessary rights to submit it;

  • It is accurate and based on a genuine experience;

  • It is lawful and does not violate another person’s rights; and

  • It does not contain malware, deceptive information or prohibited material.

You grant Pulse Recovery a non-exclusive, worldwide, royalty-free licence to use, reproduce and display submitted content for operating and promoting the store.

We may moderate or remove content that is unlawful, misleading, abusive, defamatory or infringing.

15. Prohibited Uses

You may not use the website to:

  • Break any applicable law;

  • Commit or facilitate fraud;

  • Infringe intellectual-property or privacy rights;

  • Transmit malware or harmful code;

  • Harass, threaten or impersonate another person;

  • Interfere with the website’s operation or security;

  • Collect personal information without authorization;

  • Submit false or misleading information; or

  • Circumvent security or access-control measures.

We may restrict access where reasonably necessary to protect customers, the store, Shopify or another party, subject to applicable law.

16. Shopify and Other Third-Party Services

This store is powered by Shopify and may use independent services for:

  • Payments;

  • Product sourcing;

  • Order fulfilment;

  • Shipping and tracking;

  • Analytics;

  • Customer communication; and

  • Social-media functionality.

Purchases made through the store are transactions between you and Pulse Recovery, not Shopify.

Third-party services operate under their own terms and privacy notices. Pulse Recovery remains responsible for its obligations as the retailer where required by law.

We are not responsible for third-party websites or services outside our reasonable control.

17. Privacy

Personal information is processed according to our Privacy Policy and applicable data-protection laws, including the Protection of Personal Information Act 4 of 2013 where applicable.

Information may be shared with Shopify, payment providers, suppliers, fulfilment partners and couriers where necessary to operate the store, process payments and deliver orders.

18. Website Availability and Errors

We aim to maintain an accurate, secure and reliable website but cannot guarantee uninterrupted or error-free access.

We may:

  • Perform maintenance;

  • Correct errors;

  • Update website information;

  • Modify or discontinue features; or

  • Temporarily restrict access for security reasons.

We will not retrospectively remove rights relating to orders already accepted.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Pulse Recovery will not be liable for indirect, incidental, special or consequential loss resulting from:

  • Unreasonable product use or misuse;

  • Failure to follow product instructions or warnings;

  • Reliance on general website content as medical or professional advice;

  • Temporary website interruptions;

  • Incorrect information supplied by a customer; or

  • Third-party services outside our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising from:

  • Fraud;

  • Gross negligence;

  • Unsafe or defective goods;

  • Death or personal injury where liability cannot be excluded; or

  • A mandatory consumer right.

20. Events Outside Our Control

We are not responsible for a failure or delay caused by events beyond our reasonable control, including:

  • Natural disasters or severe weather;

  • Strikes or transport disruptions;

  • Customs delays;

  • Government restrictions;

  • Internet or payment-network failures;

  • Courier interruptions; or

  • Supplier and fulfilment disruptions.

We will take reasonable steps to reduce the effect of such events and communicate material delays where possible.

21. Termination

We may suspend or terminate access to the website where a user materially breaches these Terms, engages in unlawful conduct or creates a genuine security risk.

Termination does not affect rights or obligations that arose before termination, including payment obligations and valid consumer claims.

22. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa.

Disputes may be submitted to an appropriate South African court, consumer tribunal or other competent forum.

This clause does not prevent an international customer from relying on mandatory consumer protections or a competent forum available under the laws of their country.

23. Severability and Waiver

If any part of these Terms is found to be unlawful or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

A failure to enforce a provision does not waive our right to enforce it later.

24. Changes to These Terms

We may update these Terms when our products, services, business practices or legal obligations change.

The current version and effective date will be published on the website. Material changes will apply prospectively unless applicable law permits otherwise.
